OAK BLUFFS CONSERVATION COMMISSION

Will hold a public hearing under the Massachusetts Wetlands Protection Act and the Oak Bluffs General Wetlands Bylaw on a Notice of Intent filed by the Town of Oak Bluffs Shellfish Department to remove cement plugs at the ends of a culvert to increase flushing in Farm Pond, at Sea Views Avenue, Map 18, Lot 32. The hearing will take place Tuesday, November 13, 2007 at 4:00 p.m. in the Town Hall on School Street. The plans are available for review in the Commission office at the Town Hall.


UPDATE (posted November 15th, 2007)

The notice of intent to remove the concrete plugs from each end of the old culvert was submitted to the Oak Bluffs Conservation Commission, MA Department of Environmental Protection, MA Division of Marine Fisheries and to MA Heritage. MA Heritage is the State agency that deals with endangered and threatened species.
 
A hearing before the Oak Bluffs Conservation Commission on November 13th was held. All four members at the hearing voted unanimously to approve the project. Their vote of approval started the clock for a 10 day appeal period. The appeal would have to be filed with the MA Department of Environmental Protection within the appeal window. The local Conservation Commission then has 21 days to issue their “Order of Conditions”; which is their permit. We also have to wait for both the Division of Marine Fisheries and MA Heritage to sign off that they have no objection to the project. If they do, they will schedule a site visit to see if alternatives can be done to protect their respective issues. There is no indication that there will be any objections. This means that we should be able to remove the plugs in three to four weeks.
